STROUD SHARKS CONSTITUTION

​

1. NAME

 

The club will be called Stroud Sharks Basketball Club (the Club) and will be affiliated to Basketball England.

 

 

2. OBJECTIVES

 

  1. To increase participation in youth basketball within the Stroud Valleys and surrounding areas.

  2. To ensure the safety and well-being of all Members, and in particular children, through the application of suitable and relevant safeguarding policies. These will, as a minimum, comply with the requirements of Basketball England. (Appendix A details the relevant and specific Club safeguarding requirements).

  3. To be inclusive and to support all Club Members – in particular maintaining a philosophy of continuous player development.

  4. To seek to be competitive within any leagues or competitions entered (in line with the objectives above) whilst upholding the values of sportsmanship, teamwork, respect and enjoyment.

  5. To provide opportunities for Members to develop additional skills and to hold roles within the Club relevant to their age and maturity (e.g. junior coaching, first aid, table officiating, refereeing) seeking to enhance their confidence and leadership.

  6. To view success against the objectives by measuring;

    • ​The percentage of youth Members retained as they progress through the age groups offered

    • The number of youth Members selected for representative games (District / County / Regional / Aspire) or progressing to higher levels of basketball not currently offered within the Club (e.g. U14/U16/U18 NBL or full NBL)

    • Generic or specific (targeted) feedback received from Club Members or their parents, other basketball clubs and officials in respect of the clubs’ overall provision of basketball and support to Members.​

3. MEMBERSHIP

 

  1. Eligibility

    • ​Club membership will consist of Officers (who form the Club Committee), nominated Coaches and Members of the Club who by joining the club will be deemed to support the Objectives of the Club.

  2. ​Categories of Membership

    • ​Officers: Officers of the Club will form a committee and will determine the Constitution and in particular the Objectives of the Club and will vote on all matters in respect of the Club.

    • All other Members including coaches will have the right to participate in activities but will not have any voting rights

4. MEMBERSHIP FEES

 

Membership fees will be set annually and agreed by the Committee at an applicable meeting.

5. OFFICERS OF THE CLUB

 

The current officers of the club who are eligible to vote are as follows;

  • Chair/Club Secretary

  • Vice Chair

  • Welfare Officer

  • Treasurer

  • Coaching Coordinator

6. ELECTION AND TERM

 

Officers will normally serve a term of 2 years. Officers will be elected (or re-elected) at the Annual General Meeting following the Election Process. Officers will be at least 18 years of age at commencement of their term.

7. ELECTION PROCESS

 

  • The Club Secretary will inform Members of relevant Officer positions on the committee that are due to be subject to the Election Process. The notifica-tion will explain the Election Process and the time period for nominations, allowing any Member to nominate themselves or others for Officer positions.

  • Nominees (nominated by others) will be informed and given time to accept or decline their nomination.

  • All nominees wishing to be considered for election will then be listed for con-sideration and voting at the annual general meeting (AGM).

  • The Club Secretary will conduct a voting process at the AGM, ensuring ac-curacy and impartiality, and will then verify the results.

  • The Club Secretary will announce the election results to all club members and confirm the terms of the newly elected or re-elected committee mem-bers.


By following these streamlined steps, the sports club can efficiently manage the re-election of committee members while maintaining transparency and fairness.

8. MANAGEMENT COMMITTEE (MC)

 

The club will be managed through the MC consisting of the Officers of the Club. Only Officers will have the right to vote at meetings of the MC. All Officers will be invited to attend each meeting.

The quorum required for business to be agreed at MC meetings will be three. The MC will;
 

  • attend meetings that will be convened by the Secretary of the Club and held no less than 2 times per year – one of which will be the AGM.

  • be responsible for defining the club's Constitution and in particular the Objectives of the Club, the overall development plan, organising any sub-committees to deliver this plan, adopting new policy, codes of practice and rules that affect the organisation of the club.

  • have powers to appoint subcommittees as necessary and appoint advisers to the MC as necessary to fulfil its business

  • be responsible for disciplinary hearings of members who infringe the club rules/regulations/constitution. The MC will be responsible for taking any action of suspension or discipline following such hearings.

9. FINANCES

 

  • All club monies will be banked in an account held in the name of the club.

  • The Club Treasurer will be responsible for the finances of the club.

  • The financial year of the club will end on March 31st

  • An independently reviewed statement of annual accounts will be presented by the Treasurer at the Annual General Meeting (the MC will determine who the independent review is completed by).

10. ANNUAL GENERAL MEETINGS (AGM)

 

  • A notice of the AGM will be given by the Club Secretary with a minimum 21 days notice given to the MC members.

  • The AGM will receive a report from officers of the MC and a statement of the reviewed accounts.

  • Nominations for officers of the MC will be sent to the Secretary prior to the AGM in line with the Election Process

  • Elections of officers are to take place at the AGM.

  • All MC members have the right to vote at the AGM.

  • The quorum for AGMs will be three.

  • The MC has the right to call for any extra meetings (Extraordinary General Meetings or EGMs) as it deems necessary. Procedures for these will be the same as for the AGM.

11. DISCIPLINE AND APPEALS

 

  • All concerns, allegations or reports of poor practice/abuse relating to the welfare of children and young people will be recorded and responded to swiftly and appropriately in accordance with the club’s child protection policy and procedures.

  • The club Welfare Officer is the lead contact for all members in the event of any child protection concerns.

  • All complaints regarding the behaviour of members should be presented and submitted in writing to the Secretary.

  • The MC will meet to hear complaints within seven days of a complaint being lodged. The MC has the power to take appropriate disciplinary action including the termination of membership.

  • The outcome of a disciplinary hearing should be notified in writing to the person who lodged the complaint and the member against whom the complaint was made within a week of the hearing.

  • There will be the right of appeal to the MC following disciplinary action being announced. The MC should consider the appeal within seven days of the Secretary receiving the appeal.

12. DISSOLUTION

 

  • A resolution to dissolve the club can only be passed at an AGM or EGM through a majority vote of the MC.

  • In the event of dissolution, any assets of the club that remain will be donated to suitable basketball activity within Stroud and its surrounding area (clubs, schools or basketball facilities) - to be determined by the MC.

13. AMENDMENTS TO THE CONSTITUTION

 

The constitution will only be changed through agreement by majority vote at an AGM or EGM.

14. DECLARATION

 

Stroud Sharks Basketball Club hereby adopts and accepts this constitution as a current operating guide regulating the actions of members.

APPENDIX A - MINIMUM WELFARE REQUIREMENTS

i. All Club training sessions and matches will be lead by a Basketball England Level 2 qualified coach. Level 2 coaches will hold a Disclosure Barring Service ‘DBS’ document and a Safe-guarding training record - both of which will have been verified and approved independently by Basketball England.

ii. Any other adult volunteers who have access to children will hold a ‘DBS’ document and will have relevant and appropriate safeguarding training and knowledge. Both the DBS and Safeguarding training record will be checked by the Club Welfare Officer.

iii. The Club Welfare Officer will maintain a central record within the Club and will ensure periodic checks of validity are undertaken (e.g. to ensure dates are still relevant) and will prompt any upcoming renewals.

iv. Adults where their DBS has expired will not be able to undertake any activity with children.

v. The Club will ensure that junior (U18) assistant coaches receive basic ‘Safeguarding of children’ training as part of their own coaching development such that they understand the general requirements. The Club Welfare Officer will determine the appropriate level of training for any junior assistant coaches.

vi. A Level 2 coach may be assisted by other adults or junior assistant coaches subject to the application of ii) or v) above.

vii. The Club will work with parents of Club Members to understand any medical conditions of Members and any appropriate actions to be taken for those Club Members in the event of an ‘incident’. The Club will seek to ensure an appropriate level of confidentiality – save for ensuring relevant coaches are aware of the condition and the required actions.

viii. The Club will seek to ensure that at least one First Aid trained person is available at official Stroud Sharks training sessions and matches. Such person may be an employee of the sports facility or a parent of a player. The Level 2 Coach leading the session will always ensure that the injured party is accompanied – either by themselves or by another Club adult volunteer who has relevant DBS clearance and Safeguarding training whilst being helped by another First Aider.
